This Disclaimer applies to all services, programs, content, and materials provided by BuiltSimple, including but not limited to Foundation, Men of Momentum, any current or future membership tier, and any individual coaching services offered under the BuiltSimple brand (collectively, the "Programs").
By accessing this website, purchasing any Program, or participating in any training session provided by BuiltSimple, you acknowledge and agree to the following terms.
1. Educational Purpose Only
All content provided by BuiltSimple — including training programs, workout plans, videos, exercise demonstrations, coaching materials, written content, and any nutritional guidance — is provided for general educational and informational purposes only.
BuiltSimple does not provide medical advice, diagnosis, or treatment. Nothing in the Programs or related materials should be interpreted as medical, therapeutic, or healthcare advice.
2. No Medical Relationship
Your participation in any BuiltSimple Program does not create a doctor-patient relationship, a therapist-client relationship, or any other medical advisory relationship.
If you have any medical condition, injury, cardiovascular risk factor, or other health concern, you must consult a licensed physician or qualified healthcare professional before starting any exercise program. You agree not to rely solely on information provided by BuiltSimple when making health-related decisions.
3. Assumption of Risk
You acknowledge that physical exercise and strength training involve inherent risks, including but not limited to muscle strains, ligament injuries, joint injuries, falls, overuse injuries, cardiovascular stress, dizziness, fainting, and serious bodily injury. You understand that these risks cannot be fully eliminated.
By participating in any BuiltSimple Program, you voluntarily assume full responsibility for all risks associated with your participation. You confirm that you are physically capable of engaging in exercise and that you choose to do so at your own risk.
4. Personal Responsibility & Self-Monitoring
You are solely responsible for:
selecting appropriate exercise variations
scaling movements to your own level
maintaining proper technique
ensuring adequate rest and recovery
stopping immediately if pain, discomfort, dizziness, or unusual symptoms occur
BuiltSimple cannot supervise your execution of exercises and is not responsible for injuries resulting from improper form, overexertion, or failure to follow safety guidelines.
5. No Guarantees of Results
Individual results vary. Outcomes depend on numerous factors, including consistency, effort, nutrition, sleep, stress levels, genetics, and prior training history.
BuiltSimple makes no guarantees regarding specific strength increases, muscle gain, fat loss, aesthetic outcomes, or performance improvements. Any testimonials or examples shown are individual results and are not guarantees of future outcomes.
6. Digital Content — No Right of Withdrawal
All BuiltSimple Programs are delivered as digital content with immediate access upon purchase.
By purchasing a Program, you expressly request immediate access to the digital content and expressly acknowledge that:
your right of withdrawal (where such a right would otherwise apply under your local consumer protection law) is waived once digital content delivery has begun, and
you lose this right of withdrawal upon commencement of performance, i.e. as soon as you access the content.
This waiver applies to Foundation, Men of Momentum, and any other digital program, download, or membership content offered by BuiltSimple. Where required by applicable law, this acknowledgment is confirmed by you at checkout prior to purchase.
This section does not affect any statutory right you may have to a remedy in the event that digital content is defective or not as described.
7. Limitation of Liability
To the fullest extent permitted under the laws of the State of Florida and applicable U.S. federal law, BUILTSIMPLE LLC, its owners, employees, and representatives shall not be liable for any direct, indirect, incidental, consequential, or special damages — including loss of profits, loss of data, or personal injury — arising from the use of its Programs, website, or materials.
This limitation does not apply where liability arises from intentional misconduct, gross negligence, or injury to life, body, or health caused by negligence, to the extent such liability cannot be excluded under applicable law.
8. Digital Service Availability
BuiltSimple provides digital services and app-based content. We do not guarantee uninterrupted access, error-free operation, permanent availability, or compatibility with all devices. You are responsible for ensuring you have compatible hardware, software, and internet access.
9. International Users
BuiltSimple provides services worldwide. You are responsible for ensuring that your participation in the Programs complies with the laws and regulations of your country of residence. Nothing in this Disclaimer limits any mandatory consumer protection rights available to you under the law of your country of residence, to the extent such rights cannot be waived.
10. Governing Law & Jurisdiction
This Disclaimer and your use of the Programs are governed by the laws of the State of Florida, USA, without regard to its conflict of law principles, without prejudice to any mandatory consumer protection provisions of your country of residence that may apply to you as a consumer. Any dispute arising from this Disclaimer shall be subject to the exclusive jurisdiction of the courts located in the State of Florida, USA, except where mandatory local law requires otherwise.
11. Indemnification
You agree to indemnify and hold harmless BuiltSimple, BUILTSIMPLE LLC, its operators, affiliates, and representatives from any claims, damages, liabilities, costs, or expenses arising from your participation in a Program, your misuse of the content, or your violation of these terms or of applicable law.
12. Eligibility
You must be at least 16 years old to purchase or participate in any BuiltSimple Program. If you are between 16 and 18 years old, you confirm that you have obtained the consent of a parent or legal guardian prior to participation.
13. Acceptance
By purchasing, accessing, or participating in any BuiltSimple Program, you confirm that:
you have read this Disclaimer in full,
you understand its contents,
you voluntarily agree to its terms, and
you accept full responsibility for your participation.
If you do not agree with this Disclaimer, you must not participate in the Programs.
